1. Overview

Kincer Industries LLC, doing business as Thundergoat Labs ("Thundergoat Labs," "we," "our," or "us"), develops ModBook with a privacy-by-design approach. ModBook is designed so your vehicle records are primarily stored on your own device and, if enabled by you, synced through your personal iCloud account.

2. Data Collection (ModBook)

• Local Storage: Vehicle data, modification logs, and maintenance records are stored locally on your device.
• iCloud Syncing (Optional): If enabled, your data syncs through your Apple iCloud account across your devices.
• VIN Decoding: When you use VIN lookup, the VIN is sent to the NHTSA vPIC API to retrieve vehicle specification data.
• Support Communications: If you contact us, we receive the information you provide (such as your email address and message contents).
• Website Technical Logs: If you visit our site, hosting providers may process technical request data (such as IP address, browser type, timestamp, and request path) for security and service delivery.

3. How We Use Information

• Provide and maintain ModBook functionality.
• Respond to support requests and troubleshoot issues.
• Improve reliability, performance, and security.
• Comply with legal obligations and enforce our terms.

ModBook does not use third-party SDK tracking for cross-context behavioral advertising. If this changes, we will update this policy and request any platform-required permissions.

4. Third-Party Services and Data Sharing

We may share or disclose information in limited situations:

• Apple: For app distribution, optional iCloud syncing, purchases/subscriptions, and related platform services.
• NHTSA vPIC API: For VIN decoding requests initiated by you.
• Service Providers: For support, infrastructure, security, and operations.
• Legal Requirements: If required by law, court order, or valid legal process.
• Business Transfers: In connection with a merger, acquisition, financing, or asset transfer, as permitted by law.

We do not sell personal information for monetary consideration.

We require service providers and other third parties that process personal information on our behalf to provide the same or an equivalent level of privacy protection, to process data only for disclosed purposes, and to implement appropriate security safeguards.

5. Data Retention

Data you create in ModBook is primarily retained by you on your device and optionally in your iCloud account according to your Apple settings. Information we directly receive (such as support emails) is retained only as long as reasonably necessary for support, security, legal, and recordkeeping purposes, then deleted or de-identified.

6. Security

We use reasonable administrative, technical, and organizational safeguards appropriate to the information we process. No transmission or storage method can be guaranteed 100% secure.

7. International Transfers

Service providers may process information in countries other than your own. Where required by law, we use appropriate safeguards for cross-border transfers.

8. Children’s Privacy

ModBook is not directed to children under 13, and we do not knowingly collect personal information from children under 13 without legally required parental consent.

9. Your Privacy Rights

Depending on where you live, you may have rights to request access, correction, deletion, portability, and restriction or objection to certain processing.

California residents may have rights under the CCPA/CPRA, including rights to know, delete, and correct personal information, and to opt out where applicable. Residents of other U.S. states and EEA/UK users may have additional rights under applicable law.

10. How to Exercise Your Rights

To submit a privacy request, contact support@thundergoatlabs.com. We will verify and respond within the timelines required by applicable law.

For data stored on your device or iCloud account, you can edit or delete records within ModBook and manage iCloud sync in Apple device settings.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Updated versions will be posted on this page with a revised "Last Updated" date.
